This website is operated by River & Root, a trading name of FitStreak Ltd.

FitStreak Ltd is registered in England and Wales under company number 16557846, with its registered office at 7 Ascot Drive, Wirral, CH63 2QP, United Kingdom.

Throughout these terms, “River & Root”, “we”, “us” and “our” refer to FitStreak Ltd trading as River & Root.

2. These terms

These terms apply when you access our website or purchase products from us. Please read them before placing an order.

Our Privacy Policy, Shipping Policy and Returns and Refunds Policy also apply and form part of these terms.

Nothing in these terms affects your statutory rights as a consumer.

3. Using our website

You may use our website only for lawful purposes. You must not misuse the website, introduce malicious software, attempt to gain unauthorised access or interfere with its operation or security.

We may suspend or restrict access to the website where reasonably necessary for maintenance, security or legal reasons.

4. Our products

We take reasonable care to ensure that product descriptions, photographs and other information are accurate. However, colours and appearance may vary slightly depending on your device, lighting and the natural characteristics of the product.

Product packaging or presentation may occasionally differ slightly from photographs without affecting the product’s essential characteristics.

Please read and follow all instructions, warnings and usage information supplied with the product. Products must only be used for their intended purpose and in accordance with any instructions and warnings supplied with them.

We reserve the right to change or discontinue products and to limit the quantity available to purchase.

5. Prices and payment

All prices are shown in pounds sterling and include any applicable taxes. Any applicable delivery charges will be clearly displayed before you complete your purchase.

We may change our prices at any time, but changes will not affect orders that we have already accepted.

Payment must be made using one of the payment methods available at checkout. Payments are processed securely by Shopify and its payment providers.

6. Orders

When you place an order, you are offering to purchase the products in your basket. An automated order acknowledgement does not necessarily mean that we have accepted your order.

A contract is formed when we send confirmation that your order has been dispatched. We may decline or cancel an order before dispatch if, for example:

  • the product is unavailable;

  • payment cannot be authorised;

  • there is an obvious pricing or product-description error;

  • delivery is not available to the address provided; or

  • we reasonably suspect fraud or misuse.

If we cancel an order after taking payment, we will refund the amount paid.

Please check your order and contact us promptly if any information is incorrect.

7. Delivery

We currently deliver only to addresses within the United Kingdom.

Standard UK delivery is free. We aim to dispatch orders within 2 working days. Estimated delivery times are set out in our Shipping Policy, but delivery dates are estimates and are not guaranteed.

We are responsible for your order until it is delivered to you or to someone you have nominated to receive it. If you ask the courier to leave the order in a safe place, responsibility passes to you once it has been delivered there.

If delivery is significantly delayed because of circumstances outside our reasonable control, we will contact you and explain the options available.

Unless a different timeframe has been agreed with you, your order will be delivered within 30 days of acceptance.

8. Cancellations, returns and refunds

Your rights to cancel an order, return products and receive a refund are explained in our Returns and Refunds Policy.

UK consumers generally have the right to cancel an online order within 14 days of receiving it and then a further 14 days to return it. Our voluntary returns policy may provide additional time.

Products must be handled only as reasonably necessary to inspect them. We may make a deduction from a refund where handling has reduced the product’s value, as permitted by law.

9. Faulty, damaged or incorrect products

Products must be as described, fit for purpose and of satisfactory quality in accordance with the Consumer Rights Act 2015.

If a product is faulty, damaged or incorrect, please contact hello@rivandroot.com with your order number and relevant details. Your legal rights regarding faulty goods are not limited by our voluntary returns policy.

10. Intellectual property

The website and its contents—including the River & Root name, branding, logos, product designs, text, photographs and graphics—are owned by or licensed to us and are protected by intellectual property law.

You may view the website and retain order information for personal, non-commercial use. You must not reproduce, modify, distribute or commercially exploit our content without prior written permission.

11. Shopify and third-party services

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer products to you.

Purchases made through this store are transactions between you and FitStreak Ltd trading as River & Root. Shopify is not the seller of our products.

Our website may include links to third-party services. We are not responsible for the content or practices of third-party websites, and their own terms and privacy policies will apply.

12. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory rights; or

  • defective products where liability cannot legally be excluded.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Our products and website are supplied for private and domestic use. We are not responsible for business losses, including loss of profit, revenue, business or opportunity, where you use a product for commercial purposes.

13. Personal information

We process personal information in accordance with our Privacy Policy.

14. Changes to these terms

We may update these terms to reflect changes to our business, website or legal obligations. The terms applying to an order will be those in effect when the order was placed.

15. Severability

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

16. Governing law

These terms and any contract between you and us are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you retain any mandatory rights and may bring proceedings in your local courts. Otherwise, the courts of England and Wales will have jurisdiction.
